Plaintiff assigned the false oath with certainty (that defendant brought a writ of Forcible entry against plaintiff, plaintiff pleaded not guilty, and was found guilty.
The (prospective) jurors of the Attaint (jury) were demanded, and appeared.
Defendant challenged the array (of prospective jurors) because plaintiff chose the sheriff as arbitrator in an arbitration with defendant on the title to the land in which forcible entry was supposed, and prayed that the array be quashed.
Plaintiff prayed that the Attaint jury.
Argument whether the challenge was principal.
Plaintiff replied that the sheriff was chosen to be indifferent.
Newton CJCP told the parties to say what they wanted on either side, and to demur bravely and to test the law.
Defendant challenged as before, and said that the sheriff had conferred with the other arbitrators on several occasions in this arbitration.
Plaintiff replied that when he chose the sheriff and another, defendant chose them too as indifferent.
The Justices chose two (prospective jurors) from the array to try the challenge.
The two triors were sworn.
The triors found that plaintiff chose the sheriff as an arbitrator for his part, but that the arbitrators arbitrated indifferently, and prayed the Justices' discretion.
The jurors were discharged until another day so that the Justices could be advised. |

Sjt Portyngton (for D): the sheriff and one K. were chosen arbitrators on the part of plaintiff against one W. Moile and one G.A. arbitrators chosen on defendant's part
Newton CJCP: if I bring a writ of Debt against you, and we are at issue, and you challenge a juror, and you say that he was chosen arbitrator on my part in a writ of Trespass that I brought previously against you, and you pray that he (the challenged juror) be withdrawn, this is no cause, because he was chosen arbitrator in another matter than that for which he is now impanelled, but in the same matter there is no question but that it will be a principal challenge; And to this that you said of a principal challenge, perpetual, etc. if there had been alliance between the sheriff and thei plaintiff, even though it could be terminated by death, yet this alliance is a good challenge to quash the array; even though the sheriff have all the ill will and malice that he could have toward plaintiff or toward defendant, if he in making the array (of prospective jurors) came and truly made it without showing any favour to the one or to the other, this array is good, andif he put in a suspicious juror, and not indifferent, all the array is quashed; and if a juror said that he would pass with (give a verdict for) the plaintiff, his saying this is no cause to withdraw him if it be not found by the triors or by the Court, that he said this more for favour than he said it for the truth of the matter (to which all the Court agreed)
