Under the Fair Labor Standards Act (FLSA), employees may be hired into either exempt or non-exempt positions:

An exempt (salaried) employee is one who holds a position that meets specific criteria established by the Fair Labor Standards Act. For example, employees who hold certain professional, administrative, executive, or computer positions. Exempt employees are paid semi-monthly, and are not eligible for overtime pay.

A non-exempt (hourly) employee is one who does not fall into one of the exempt categories. For example, employees who perform administrative, secretarial, clerical, technical, trade, or service work are classified as non-exempt. Non-exempt employees are paid on an hourly basis weekly, and are eligible for overtime compensation for all hours worked in excess of 40 hours in the payroll week. Overtime pay is calculated at one and one-half times the employee’s regular hourly rate.
