Process and Pleading
Defendant pleaded (alleged) that plaintiff was excommunicated.
It was well disputed what would be done with defendant.
It was said that defendant should not be arraigned at the king's suit, should not be left in prison or at mainprise, and should not be dismissed.
This matter was well disputed, but the reporter was not present (sed non interfui).
At last, plaintiff went without day.
Defendant was left to mainprise (bail) until a certain day.
In the meantime the Court wanted to be advised.

it was said that (1) he (Appeal defendant) could not be arraigned at the king's suit, in that (eo que) the plaintiff could be absolved (assoile) and (should then) have his Appeal, and (2) if the defendant will be in prison or left (lessa) to mainprise (bail) then it could be that the plaintiff does not yet want to be absolved (assoile), and so the defendant will always be in prison (lifetime imprisonment), and (3) if the defendant will be dismissed, then the king can be defrauded by such excommunication (of Appeal plaintiff), so that the defendant will not be arraigned at his (the king's suit)
