Process and Pleading
Process continued until Capias.
The sheriff, at the day of (return of) Capias, returned that defendant languished ill (languidus) in prison.
A Distraint went to the new sheriff to make the former sheriff have his prisoner (in Court).
The (new) sheriff returned issues of 4 shillings on the old sheriff.
Alias distraint issued.
The (new) sheriff returned issues.
An apprentice (perhaps representing the old sheriff's widow's second husband?), said that he against whom this Distraint had gone (the old sheriff?) was dead, and one was here at the bar who had married (espouse) the (old sheriff's?) widow, so (the second husband of the old sheriff's widow?) prayed that process could cease.
Fairfax JKB said that it did not appear to the Court whether (the old sheriff?) was dead or not, so another Distraint should issue unless (the old sheriff) had delivered defendant to the (new) sheriff by a deed indented.
The Court awarded another Distraint notwithstanding the apprentice's client's surmise.

Philpot, Apprentice: he against whom this Distraint has gone is dead, and he is here at the bar who has married (espouse) the woman, so we pray that the process can cease
Farifax JKB: it does not appear to the Court (Non constat Curiae) whether he (the old sheriff?) be dead or not, because he (the old sheriff?) cannot appear by bare words (nude parol) or surmise, but he ought to come in by the (new) sheriff's return and the (new) sheriff has returned issues against him (the old sheriff?) this day, so it does not appear to the Court that he (the old sheriff?) is dead, so ti seems to me that another Distraint will go unless he (the old sheriff) has delivered to the (new) sheriff the party (defendant) who was arrested, by deed indented,
