A writ was brought against a woman, who made default. The grand cape issued, returnable now, and the woman came here now, and the plaintiff's attorney held to the default and prayed seisin of the land. Shardelow JCP asked the attorney what he demanded against the woman by his writ, and the attorney said that the demand was of a messuage. Upon this, the woman demanded the view, and the attorney said that he held to the default. Herle CJCP said that the plaintiff had made his demand against the woman, so he told the plaintiff to waive the default and put the woman to plead to him, and she had the view.
